Please read these Terms and Conditions ("Terms") carefully before using zizismacarons.co.za (the "Website") or purchasing "The Macaron Method" ebook (the "Product"). By accessing the Website or purchasing the Product, you ("you", "the customer") agree to be bound by these Terms. If you do not agree, please do not use the Website or purchase the Product.

As a sole proprietor, Ziyaanah Ahmad trades under the name "Zizi's Macarons" and is personally responsible for all business obligations arising from the operation of the Website and sale of the Product. Where these Terms refer to "we", "us", or "our", this means Ziyaanah Ahmad trading as Zizi's Macarons.
These Terms are governed by the laws of the Republic of South Africa, including the Consumer Protection Act 68 of 2008 ("CPA"), the Electronic Communications and Transactions Act 25 of 2002 ("ECTA"), and the Protection of Personal Information Act 4 of 2013 ("POPIA"), to the extent applicable.
2. The Product
2.1 "The Macaron Method" is a digital ebook (the "Product") providing instructions, tips, and guidance intended to help home bakers learn how to make macarons. It is sold and delivered exclusively in digital/electronic format (e.g. PDF or similar file format).
2.2 No physical product is shipped or delivered. Nothing purchased through the Website entitles you to a physical copy, printed book, ingredients, equipment, or baked goods of any kind.
2.3 We reserve the right to update, revise, or improve the content of the Product from time to time. Where reasonably possible, customers who have already purchased the Product will be given access to material updates at no additional cost, but this is not guaranteed unless expressly stated at the time of purchase.
2.4 Product descriptions, previews, and marketing content on the Website are provided in good faith. While we aim for accuracy, results from following the Product's instructions may vary based on individual skill, equipment, ingredients, and environmental factors (such as humidity), which are outside our control.
3. Orders and Access
3.1 Orders are placed and paid for via the Website. Upon successful payment, you will receive access to download the Product, typically via an automated email containing a download link and/or access instructions.
3.2 It is your responsibility to provide a valid and correctly spelled email address at checkout. We are not responsible for non-delivery caused by an incorrect email address, spam filters, or issues with your email provider, but we will assist in resending access where reasonably possible.
3.3 Download links may be time-limited or restricted in the number of times they can be accessed, for security and anti-piracy purposes. If you experience technical difficulty accessing your Product, please contact us at contact@zizismacarons.co.za and we will assist you.
3.4 You are responsible for ensuring you have a device, software, and internet connection compatible with the file format of the Product (e.g. a PDF reader) prior to purchase.
4. Pricing and Payment
4.1 All prices are listed in South African Rand (ZAR) and are inclusive of VAT where applicable, unless stated otherwise.
4.2 We reserve the right to change the price of the Product at any time. The price applicable to your purchase is the price displayed and confirmed at the time your order is placed and paid for.
4.3 Accepted payment methods: Card Payment Via Yoco.
4.4 Full payment is required before access to the Product is granted. Access will not be provided for unpaid or incomplete transactions.
4.5 We take reasonable steps to protect your payment information. Payments are processed through a secure third-party payment gateway; we do not store your full card details.
5. Refund Policy
5.1 As "The Macaron Method" is a digital product delivered electronically and accessible/downloadable immediately upon purchase, all sales are final and non-refundable once access has been granted or the Product has been downloaded, except as set out below or as required by law.
5.2 In terms of the Consumer Protection Act and ECTA, the right to cancel certain distance-sale transactions within a cooling-off period does not typically apply to digital content once access or download has commenced with your consent, as the transaction is complete upon delivery.
5.3 If you experience a genuine technical fault preventing you from accessing or downloading the Product (e.g. a corrupted file), please contact us within 7 Days of purchase at contact@zizismacarons.co.za, and we will investigate and, where appropriate, provide a replacement file or a refund.
5.4 If you believe you were charged in error (e.g. duplicate payment), please contact us with proof of payment and we will investigate and refund any duplicate or erroneous charges.
5.5 We do not offer refunds for change of mind, dissatisfaction with personal results achieved from following the Product, or failure to read the Product description prior to purchase.
6. Intellectual Property and Licence to Use
6.1 "The Macaron Method," including all text, recipes, images, layout, and any accompanying materials, is the intellectual property of Ziyaanah Ahmad / Zizi's Macarons and is protected under South African and international copyright law.
6.2 Upon successful payment, you are granted a limited, non-exclusive, non-transferable licence to download and use the Product for your own personal, non-commercial use only (e.g. home baking for yourself, family, or friends).
6.3 You may not, without our prior written consent:
- Copy, reproduce, distribute, resell, rent, sublicense, or share the Product (in whole or in part) with any third party, including via file-sharing platforms, social media, or cloud storage links;
- Use the Product, or any recipes or content within it, for commercial teaching, republishing, or resale purposes;
- Remove or alter any copyright notices, branding, or watermarks contained in the Product;
- Claim authorship of the Product or its content.
6.4 Unauthorised distribution or reproduction of the Product constitutes a breach of these Terms and may result in legal action and/or revocation of your access, without refund.
6.5 You may share general feedback, results photos, or reviews of your baking (e.g. on social media) provided you do not reproduce substantial portions of the Product's written content or images without permission.
7. Disclaimer
7.1 The Product is provided for general educational and informational purposes relating to home baking. It is not a substitute for professional culinary training.
7.2 We make no guarantee regarding specific results, including but not limited to macaron appearance, texture, or success rate, as outcomes depend on factors such as your oven, ingredients, technique, altitude, and humidity, which are beyond our control.
7.3 You are responsible for your own safety when baking, including awareness of any personal food allergies or sensitivities (e.g. to almonds, eggs, or dairy, which are typically used in macaron-making) before following any recipe or instruction in the Product.
7.4 To the maximum extent permitted by law, we accept no liability for any loss, damage, injury, or adverse outcome arising from your use of the Product, except where such liability cannot be excluded under the Consumer Protection Act or other applicable South African law.
8. Limitation of Liability
8.1 To the maximum extent permitted by law, our total liability for any claim relating to your purchase or use of the Product shall not exceed the amount you paid for the Product.
8.2 We shall not be liable for any indirect, incidental, or consequential loss or damage arising from your use of the Website or the Product, except where such liability cannot be excluded under applicable law.
8.3 Nothing in these Terms limits liability for death or personal injury caused by gross negligence, fraud, or any liability that cannot be excluded under South African law.
9. Website Use
9.1 You agree to use the Website only for lawful purposes and in a way that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the Website by, any third party.
9.2 We do not guarantee that the Website will always be available, secure, or error-free, and we reserve the right to suspend, restrict, or terminate access at any time.
10. Privacy and Personal Information
10.1 We collect and process personal information (such as your name, email address, and payment confirmation details) in order to process your purchase, deliver the Product, and communicate with you, in accordance with POPIA.
10.2 We will not sell or share your personal information with third parties except as necessary to process your purchase (e.g. payment processors, email delivery services) or as required by law.

11. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Continued use of the Website or purchase of the Product after changes take effect constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts.
